ضرورت قانون‌گذاری مبتنی بر حقوق‌بشر؛ گذار از سیاست کیفری کرامت‌گریز به سیاست کیفری کرامت‌گزیر در پرتو اندیشه کانت

چکیده

امر مطلق کانت فرمانی عقلانی و بی‌قیدوشرط است که انسان را به عمل بر پایه قواعدی وامی‌دارد که بتوانند قانون عام شوند و در عین حال او را غایت فی‌نفسه و برخوردار از خودآیینی عقل عملی به‌شمار آورند. در این چارچوب، حقوق‌بشر را می‌توان یکی از برجسته‌ترین کاربردهای عملی این اصل دانست که رعایت آن نه اختیار سیاسی، بلکه تکلیفی عقلانی-اخلاقی برای دولت‌هاست. یافته‌های پژوهش بر این نکته دلالت دارد که این وظیفه بر پنج مبنا استوار است: 1) اقتضای عقل عملی، 2) ریشه‌داشتنِ حقوق‌بشر در اراده نیک، 3) وظیفه‌مندی دولت‌ها در برابر شهروندان، 4) نقش حقوق‌بشر در تحقق جمهوریت به‌عنوان یگانه شیوه مشروع حکومت، و 5) تاثیر قابل‌توجه حقوق‌بشر در دستیابی به صلح پایدار جهانی. با وجود این، تحلیل سیاست کیفری جمهوری‌اسلامی نشان می‌دهد که همگرایی با حقوق‌بشر در چهار سطح فلسفی-ارزشی، حقوقی-تفسیری، سیاسی-حکمرانی و هویتی با چالش‌های جدی روبه‌رو است؛ بنابراین، باید به‌دنبال چاره‌ بود. بااین‌حال، تسری اندیشه کانت به سنت اسلامی نیازمند توجه به تفاوت‌های بنیادین این دو است، زیرا کانت در بستر اندیشه مدرن غربی می‌اندیشید، در حالی که فقه اسلامی بیشتر بر وحی و سنت نبوی استوار است و همین تفاوت‌ها، فرایند تطبیق را پیچیده و نیازمند دقتِ نظری می‌کند. پژوهش حاضر با تأکید بر این‌که اندیشه کانت بدیل سنت اسلامی نیست، بلکه چارچوبی برای گفت‌وگو با آن را فراهم می‌کند، نتیجه می‌گیرد که گذار به سیاست کیفری کرامت‌مدار تنها با قرائتی نوین از شریعت ممکن است؛ قرائتی که در پرتو عقلانیت جهانی پذیرای حقوق‌بشر باشد، انسان را غایت فی‌نفسه بداند و در عین حال آمادگی تعامل با دیگر سنت‌های فلسفی و فکری را داشته باشد. این روزآمدسازیِ اندیشه اسلامی به‌معنای خروج از شریعت نیست، بلکه بهره‌گیری از ظرفیت‌های درونی آن برای پاسخ‌گویی به مقتضیات زمان است. چنین رویکردی می‌تواند در تعامل با سنت‌هایی چون فلسفه کانت و دیگر نظریه‌های اخلاقی، به همگرایی و گشایش‌های نظری و عملی بینجامد.

چکیده [English]

Kant's categorical imperative represents a rational and unconditional command that obliges individuals to act in accordance with maxims capable of becoming universal laws, while regarding humanity as an end in itself endowed with the autonomy of practical reason. Within this framework, human rights emerge as one of the most salient practical applications of this principle, adherence to which constitutes not a matter of political discretion but a rational-moral imperative for states. The findings of this study reveal that this obligation rests on five foundational pillars: 1) the exigencies of practical reason; 2) the grounding of human rights in the good will; 3) the duties incumbent upon states toward their citizens; 4) the instrumental role of human rights in realizing republicanism as the sole legitimate form of governance; and 5) its indispensability for attaining perpetual global peace. Nonetheless, an analysis of the Islamic Republic's criminal policy demonstrates that convergence with human rights encounters substantial challenges across four dimensions: philosophical-valuational, legal-interpretive, political-governance, and identitarian. Consequently, the imperative for remedial measures is incontrovertible. That said, extending Kantian thought to the Islamic tradition necessitates careful consideration of foundational divergences, as Kant operates within the milieu of modern Western philosophy, whereas Islamic jurisprudence is predominantly anchored in divine revelation and prophetic tradition—disparities that render the process of adaptation intricate and demanding of theoretical rigor. The present inquiry, underscoring that Kantian philosophy serves not as a substitute for the Islamic tradition but as a scaffold for dialogue therewith, concludes that the shift toward a dignity-centered criminal policy is feasible solely through a renewed hermeneutic of Sharia: one that, illuminated by global rationality, embraces human rights, posits humanity as an end in itself, and exhibits openness to engagement with diverse philosophical and intellectual traditions. Such a modernization of Islamic thought does not entail deviation from Sharia but rather harnesses its intrinsic potentials to address contemporary exigencies, thereby fostering convergence and engendering theoretical and practical advancements in interplay with paradigms such as Kantian ethics and other moral frameworks.
