بررسی تحقق صلح کانتی از رهگذر حاکمیت بین المللی قانون

چکیده

رویکرد پیشینی و جهان­شهریِ کانت در پیدایش نظریه‌های حکومت و صلح جهانی و نیز شکل­گیری نهادهای جهانی با رویکردِ حاکمیت بین‌المللی قانون مانند سازمان ملل، موثر واقع شده است. دیدگاه وی پیرامون صلح جهانی در معرفت شناسی، فلسفه اخلاق و حقوق او ریشه دارد. به باور کانت، قانون عادلانه در شرایطی محقق می­شود که همه اعضای جامعه جهانی، واجد حداکثر آزادی از انقیاد در مواجهه با اراده دیگران باشند. در سطح بین­المللی، قانون توسط دولت­های آزاد مشروعیت پیدا کرده و تمدن حقیقی جز با کنار گذاشتن اندیشه جنگ امکان­پذیر نمی­باشد. بنابراین حاکمیت قانون، ابزاری در جهت حفظ صلح و امنیت بین‌المللی و ترویج و اعتلای حقوق بشر است. در نظر کانت، تحول از حالت طبیعی جنگ به حالت صلح در میان انسان­ها ضمن مراحلی رخ می­دهد. برای تحقق صلح ابدی در بین ملت­ها، ضرورت دارد تا لوازم مقدماتیِ چندگانه، فراهم گردد که از آن جمله است، لغو پیمان­های سری دولت­ها. در این صورت، زمینهِ تحققِ طرح سه مرحله­ای صلح جهانی در سایه حاکمیت بین‌المللی قانون، ایجاد خواهد شد. در این نوشتار، مفهوم صلح در کنار پیش­زمینه­ها، شرایط وچگونگی رسیدن به آن از طریق حاکمیت بین­المللی قانون و موانع موجود در این راه با محوریت اندیشه کانت، مورد‌‌ بررسی قرار گرفته و چالشهای فراروی تحقق صلح کانتی مورد ارزیابی قرار‌ می‌‌‌گیرد.

Kant’s Cosmopolitan and apriori approach has influenced the formation of government and universal peace theories and international organizations such as the United Nations which have an important place in the establishment of peace and international rule of law. His views about universal peace are rooted in his epistemology and critiques. According to Kant, among human beings, the transformation from the natural state of war to the state of peace takes place in stages. At the international approach, law is legitimized by free governments, and true civilization is possible only by abandoning the idea of war. Therefore, the rule of law caused to international peace and security and protecting human rights. He said about Preliminary and Definitive Articles for Perpetual Peace among States. This paper, with the focus on Kant's thought, examined the concept of peace along with its background, conditions and how to achieve it through the international rule of law and the obstacles in this way.
