چکیده

دولت رفاه یکی از مفاهیم مهم حقوق عمومی بوده و اساس حکومت‌داری مدرن تلقی می‌شود. هرچند امروزه برخی، دوره دولت رفاه را پایان یافته می‌دانند و ادعا دارند که جهان وارد عصر دولت فرا تنظیم‌گر شده است اما واقعیت این است که حتی در دولت‌های فرا تنظیم گر نیز شاخص‌هایی از دولت رفاه دیده می‌شود. بنابراین آشنایی با مفهوم دولت رفاه، مقدمه آشنایی با مفهوم دولت فراتنظیمگر می‌باشد. اگر به بسترهای شکل‌گیری دولت رفاه نگریسته شود درمی‌یابیم که بحران‌های برخاسته از اقتصاد کلاسیک، کشورهای غربی را واداشت تا مفهوم دولت رفاه را به عنوان راه حلی در سیاست‌ لحاظ کنند. این در حالی است که مارکس سال‌ها قبل، پیرامون آسیب‌های اقتصاد کلاسیک تأمل نموده و در این خصوص هشدار داده بود. پرسش اصلی مقاله حاضر این است که انتقادات مارکس از جوامع لیبرال، چه تأثیری در ظهور مفهوم دولت رفاه داشته است؟ نتایج پژوهش حاضر نشانگر آن است که مفهوم دولت رفاه پس از مرگ مارکس زاده شده و نظریات این اندیشمند در خصوص رفاه با مفهوم دولت رفاه تفاوت‌‌هایی دارد؛ اما به نحوی، انتقادات مارکس از جامعه لیبرال، در این روند نقش بسترساز داشته است. این پژوهش به ‌لحاظ هدف بنیادی بوده و از لحاظ جمع‌آوری اسناد کتابخانه‌ای می‌باشد.

چکیده [English]

The welfare state theory is one of the key concepts of public law and it is considered one of the bases of modern governance. Although, some scholars state that the era of the welfare state is over and they claim that the world has entered the era of the post-regulatory state. Doubtless, regulatory and post-regulatory states are highly connected with the welfare state. If we study the foundations and history of the formation of the welfare state, we find that the economic crises caused by the classical economy forced the Western States to consider the theory of the welfare state as a response to the crisis. Meanwhile, this is clear that Marx had pondered and warned about the drawbacks of classical economics. To this end, the main question of this article is what is the role of Carl Marx's criticisms of the liberal economy on the emergence of welfare state theory? The results of this research show that the concept of the welfare state emerged after Marx, and the ideas of this philosopher regarding welfare have a lot of differences with the welfare state theory. This research is a doctrinal research, and the descriptive-analytical method has also been used to analyze the data.
